EU AI Act Article 18: Post-Market Monitoring System for High-Risk AI (2026)

Article 8 activates the compliance obligations for high-risk AI. Articles 9–15 define what you must do before and during deployment. Article 18 governs what you must do after your system is on the market — continuously, for the lifetime of the product.

Article 18 is deceptively short. But it establishes an obligation that has significant engineering implications: you must proactively collect, analyze, and act on real-world performance data from deployed high-risk AI systems. This is not optional post-deployment monitoring. It is a legal requirement with a documented plan that feeds into your Art.9 Risk Management System and triggers Art.19 serious incident reporting when conditions are met.

This guide explains what Art.18 requires, what "proactive collection" means for developers, how the post-market monitoring plan integrates with the rest of the compliance stack, and how to build monitoring infrastructure that satisfies the requirement without becoming a compliance burden.


What Article 18 Actually Says

Article 18(1): Providers of high-risk AI systems shall establish and document a post-market monitoring system in a manner that is proportionate to the nature of the artificial intelligence technologies and the risks of the high-risk AI system.

Article 18(2): The post-market monitoring system shall actively gather, document and analyse relevant data provided voluntarily by deployers and, where applicable, other users, or collected through other means, including data concerning the performance of the high-risk AI system, throughout the lifetime of the AI system, and allow the provider to evaluate the continuous compliance of AI systems with the requirements set out in Chapter III, Section 2.

Article 18(3): Where relevant, post-market monitoring shall include an analysis of the interaction with other AI systems. This obligation shall only apply on the basis of relevant data provided by deployers.

Article 18(4): Post-market monitoring shall be integrated into and, where relevant, co-ordinated with the post-market monitoring system of a product into which the high-risk AI system is embedded.

Article 18(5): As a result of the post-market monitoring, providers shall identify and apply any necessary corrective or restrictive measures, including as regards the information referred to in Article 53 (instructions for use), without undue delay.


The Core Obligation: Proactive, Not Reactive

The word that matters in Art.18 is actively. The obligation is not to respond to problems when they are reported — it is to proactively gather data to identify problems before they escalate.

The regulator's model is that providers should be able to detect deteriorating system performance before a serious incident occurs. Art.18 creates the legal framework for that expectation.


What the Post-Market Monitoring Plan Must Cover

Art.18(1) requires you to establish and document a post-market monitoring system. This plan must exist before market placement (it is part of the Art.11 Annex IV technical documentation).

The plan is not prescriptively defined in the regulation. But from the Art.18 text and related recitals, a compliant plan addresses:

Article 19 requires providers to report serious incidents to market surveillance authorities. Art.18 monitoring is often how those incidents are first detected.

  2. The event was not previously reported (Art.19 has a timeline obligation — typically 15 working days for expected serious incidents, 2 working days for unexpected)

Your post-market monitoring plan must include a documented procedure for evaluating whether monitoring findings trigger Art.19 reporting obligations — including who makes that determination and in what timeframe.


Multi-System Interaction (Art.18(3))

Art.18(3) adds a requirement that applies where a high-risk AI system interacts with other AI systems: the monitoring plan must include analysis of those interactions.

Common Implementation Mistakes

"We'll build this after launch." Art.18 requires the plan to be documented before market placement as part of Art.11 technical documentation. A plan that doesn't exist at launch is a compliance gap, not a roadmap.

Telemetry that can't detect degradation. If your monitoring infrastructure only records errors (5xx responses, timeout rates), it cannot detect the gradual accuracy degradation that Art.18 is designed to catch. Compliance-grade monitoring requires performance metrics, not just availability metrics.

Voluntary deployer data treated as optional collection. Art.18(2) says deployers share voluntarily — but that means you must build the channel and document the attempt. "Deployers didn't give us data" is a risk mitigation, not an excuse for having no monitoring.

Monitoring data stored outside EU jurisdiction. If your monitoring pipeline uses AWS CloudWatch, Azure Monitor, or GCP Cloud Monitoring in US regions, your Art.18 data has CLOUD Act exposure.
